The conference is aimed at judges at trial courts and at specialist insolvency courts. It aims to provide an overview of material law of insolvency and insolvency procedure law, and to enable Civil Chamber IX to exchange experiences with the judicial authorities of the Länder.
First and foremost, the discussions will concern important issues of material insolvency law which have a practical effect. A key point will be the way in which insolvency decisions are contested. Further points for discussion will be the ways in which the administrator is able to act once proceedings have been opened, the law governing contracts during an insolvency, debts incumbent on an estate, rights to separation and separate satisfaction and the liability of company directors for failing to file for insolvency in due time. Furthermore, selected legal topics from the area of insolvency procedure law (opening proceedings, registration of claims) will be discussed. The discussion on the liability of company directors will be led by a member of the Civil Chamber II, which has competence for the issue. There are no plans to discuss consumer insolvency law.
