Medical Malpractice and Medical Expertise – Basics

The conference is mainly aimed at judges at civil courts.
It deals with special problems of medical malpractice and of expertise by medical experts. Whereas these issues are getting more and more important in forensic practise, they are only treated as marginal issues in legal studies at university. Due to their complexity, it is difficult for someone working in court practise to understand these issues without assistance. This conference wants to give such assistance for people working in practise. Planned topics are among others:
  • Substantive and procedural principles of medical malpractice
  • Quality signs and sources of errors in medical expertise
  • Selection of experts, cooperation with the expert and interrogation of the expert in the hearing
  • Legal requirements concerning medical expertise in the legislation of the Federal High Court of Justice (BGH)
  • Specific problems concerning causation in medical malpractice
  • Current legislation with regard to medical malpractice.
