Recent case law of the German Federal Court of Justice on drug related crime

The conference is aimed at criminal judges and public prosecutors. In hardly any other area of criminal law, the case law of the German Federal Court of Justice is as dynamic as in the area of drug related crimes. Numerous new decisions by the Federal Court of Justice are evidence of this. An essential role - also for the ruling of coercive measures (§ 246a StPO) - is played by expert witnesses. The goal of the conference is to give the participants an update on the most recent cases of the court.
The speakers - mainly experienced judges of the German Federal Court of Justice - will deal in particular with the following practice-relevant topics:
  • Specific interpretation of evidence (eg. principles of experience)
  • The line between aiding and abetting and full control of the crime
  • Elements of crime (in particular: groups, carrying of arms)
  • Competition of criminal offences
  • Frequent procedural situations (agent provocateur, lengthy procedures, wording of rulings).
  • criminal capacity / incapacity
  • specific sentencing (eg. § 31 BtMG).
  • coercive measures according to §§ 63, 64 StGB
  • confiscation (§ 33 BtMG, §§ 73 et seq. StGB)
The latest case law is presented using numerous selected examples and particularly instructive cases are to be worked out jointly.
