Current developments in works council constitution law

This conference addresses judges working in first-instance labour courts, and judges specialising in works council constitution law at second-instance and third-instance courts.
This event adopts a systematic and practice-oriented approach to deal with current problems related to works council constitution law. It starts with the most important questions regarding procedural law, including problems related to the persons, bodies, institutions and authorities to be involved, and it also looks at the power of filing applications, proper application filing or the operative provisions to be included.
Furthermore, the aim of the conference is to provide an overview of the concept of a business enterprise and, in particular, of the problems related to (in)dependent divisions of enterprises, joint enterprises and collective agreements pursuant to section 3 of the German Works Council Constitution Act (BetrVG).
The conference addresses the legal relationship existing between an employer and a works council with reference to sections 37, 40 of the German Works Council Constitution Act (BetrVG) (works council training, works council costs), and deals with the most important facts of cases related to codetermination (sections 87, 99, 102, 111, 112). This conference adopts a practice-oriented approach, and will examine substantive law problems also from a procedural point of view in every case considered. In this context, a particular point to be reviewed will refer to the procedure defined in section 98 of the German Labour Court Law, and the sequence followed by conciliation committee proceedings.
