This conference is aimed at criminal judges, guardianship judges, prosecutors, and district attorneys.
The number of people in need of care in our society is large and will increase steadily in the coming years. At the end of 2019, there were roughly 4.13 million people in Germany requiring care, 20% of whom were cared for in full inpatient care and the remaining in private households.
Both in inpatient and home-based care settings, violence is used repeatedly against the people being cared for, as well as against the caregivers. This conference deals with the complex phenomenon of the use of force in care settings and the typically very limited possibility of its being identified and resolved. In this context, the question of the competency to testify of people suffering from dementia and the usefulness of their statements in criminal investigations will also be addressed.
Another focus of the conference is the handling of measures constituting a deprivation of liberty, particularly with regard to restraints. This topic is especially relevant given the ruling of the Federal Constitutional Court on 7/24/2018 requiring a judicial decision for the prolonged physical restraint of patients and confined persons. The isolation of residents in care homes during the coronavirus pandemic will also be discussed.
Issues relevant to guardianship and criminal law are to be developed and discussed with experts and professionals from the fields of justice, medicine, and care home supervision and management.

This conference is also offered within the framework of the European Judicial Training Network (EJTN). It is particularly suited to participants from abroad.
